Meeting Dr. Pramod Verma,

the Ex-Chief Architect of Aadhar Card India

It was really my good fortune to meet and interact with Dr. Pramod Verma, the Ex-Chief Architect of #aadhar the digital identity program of India that has covered more than 1.3 Billion people.

The pearls of wisdom that Dr. Varma gave regarding the journey of India’s path to Digitisation made me feel so proud of my #newindia.

One post will not be sufficient to describe the achievements in this path of Digitisation. The e-kyc reducing the cost of KYC from Rs1000 to Rs 3, the massive amount of beneficiaries of so many governmental schemes (that reach the ones in need) have been possible only because of this process - and not just now but even in the most difficult covid times, the opening of 47.8 crore (478 million) bank accounts in which 60 percent are of women shows our #newindia s commitment to #financialinclusivity and #womenleddevelopment.

The scale at which #upi and #upipayments have grown literally gave goosebumps seeing it as a major stepping stone in the progress of #newindia

There are so many more such achievements which will make every Indian proud.

Thank you Dr. Pramod Varma for letting us know so much about Digitisation and the path forward.

And many thanks to FICCI and FLO and FLO Jaipur chapter and our very learned President, FLO - Ms. Sudha Shivkumar for making tremendous efforts to putting this together.

APCAM International ADR Summit

It was an honour to be in the august company of the Hon’ble Judges, Ld. Arbitrators, ADR Professionals, Mediators, Legal Professionals and Academecians in the early part of this month.

As an Arbitrator and Mediator, who is still at the initial stage and age of performing these roles and functions; I had so much to learn especially regarding the critical role of institutions in facilitating international business resolutions, tech resolutions, enchacing value, exploring uncharted terrain, achieving gender equality in ADR and navigating inter cultural conflicts.

It was an honour to be part of T20 India - Think 20 India part of G20 India Presidency. I must say we all had our thinking caps on and to learn and to address issues regarding #SDGs, #COP28, agenda for #sustainabledevelopment, #digitalpublicinfrastructure from the best in the world was the most intellectual and invigorating experience to have had.

It was an honour to hear the Sherpa of #g20india Mr. Amitabh Kant, Mr. JaibalN Naduvath, Dr. Anusha Kesarkar-Gavankar, Dr Vibha Dhawan, Elizabeth Sidiropoulos, Florencia Caro Sachetti, Baratang Miya and all the other panelists.

Last but not the least, the fact that it was hosted at #nitamukeshambaniculturalcentre #nmacc in #mumbai made me so proud of the world class infrastructure that made the progression of the entire event extremely smooth and seamless.

As a special invitee to G20 EMPOWER meeting at Kovalam/Thiruvananthapuram, Kerala, it was truly empowering to be in the company of change makers - such accomplished women- that are not just empowered but will ensure that they take along with them many women who shall be empowered.

The spirits remained high for all of us and it heightened when the symbolic fist for empower and 3 fingers for women emerged and we all did that with pride.

Every time I listen to leaders such as Dr. Sangita Reddy, I realise that we are firmly and strongly walking on our path of #womenleddevelopment .

Women Led Development

#WomenLedDevelopment is a very significant aspect that I shall want to discuss on #iwd2023.

I must say that the concept of #womenleddevelopment got deeply engrained in me at the #G20empower inception meeting held under the #g20india #g20presidency.

Women Led development shows not just women empowerment but also a pragmatic future that shall witness Women in Leadership roles and decision making roles. This shall embark upon a new phase for women which would involve equal or more participation of women in every sphere.

Having said this with all the pride, I would also like to express my gratitude, like many other women in leadership roles (whether at home or at work), to the consistent and continous efforts of a lot of people such as

a supportive family (comprising of both women and men)

an enthusiastic work team (comprising of both women and men)

a series of learned mentors (comprising of both women and men)

As a special invitee to G20 EMPOWER Inception Meeting, it was an absolute honour to be invited to such an important #G20 India event at Agra.

 #G20 EMPOWER aims at empowering women to lead across various sectors and at the inception meeting it was to further discuss the role of digital skilling and future skills.

It was very empowering to listen to the most accomplished women, our own Hon’ble Smriti Irani ji, the Hon’ble Minister for Women and Child Development and Minority Affairs, India; Dr. Sangita Reddy, Ms. Tsukiko Tsukahara, Leila Elmergawi Ratna Sahay ji, @Prof RubyPawankar, Ms. Harjinder Kaur Talwar, Ms. Geetha Kannan and to interact with them about various issues and further to have such a fruitful discussion with Dr. Harbeen Arora Rai, Ha Lam, Pablo Barrera, Ms.Upasana Arora Chayaa Nanjappa among so many other esteemed delegates and invitees as well. 

I felt so proud when the Hon’ble Minister Smriti Irani ji explained all of us the true essence of #WomenLedDevelopment and I was absolutely inspired to take responsibility with pragmatism in playing a very productive and positive role in the same. 

The concept of Male Champions promoting Women Led Development of which Mr. Amitabh Kant has been a torch bearer and also appreciated by the Hon’ble Minister, is an ethos of the #NewIndia.

My learnings at G20 EMPOWER are precious learnings which I shall keep sharing as we go forward. 

Also this post would be incomplete if I do not applaud the amazing efforts of the Ministry of Women and Child Deveopment and Minority Affairs, India led by the dynamic Smriti Irani ji and the UP government in showcasing the true beauty, culture and richness of India and the beautiful city of #Agra.

Meeting with the Hon'ble Speaker of Lok Sabha Mr. Om Birla

“Every nation has a message to deliver, a mission to fulfill, a destiny to reach.”

These profound words were spoken by the most revered Swami Vivekanand.

And it was on my visit to the great Indian Parliament, while watching the Parliamentary proceedings and listening to our respected Hon’ble Prime Minister Narendra Modi ji interacting with the Hon’ble Speaker Om Birla ji that the essence of these words reverberated in my soul, just in the manner that Bharat Mata Ki Jai reverberates in the Parliament House.

It was an honour for me to be invited under the FLO (FICCI) delegation and I would like to express my deepest gratitude to Jayanti Dalmia ji and to Ms. Gayatri Rai under whose leadership the delegation was steered.

The FICCI FLO team deserves a special mention for immaculate planning and assistance in making the trip such a success.

It was truly the greatest honour to connect with the greatest stalwarts in Arbitration during the 5th ICC Arbitration India Arbitration Day.

Perhaps one could not possibly talk to each one of the greats, yet it was of immense pleasure to meet the greatest in Arbitration Tariq Khan, MCIArb (UK) ; Ganesh Chandru ; Payal Chawla ; Sneha Janakiraman ; Saloni Gupta ; Arti Rathore

The learnings with regard to the various aspects and especially the way it shall evolve in the ecosystem of India and the comparative analysis with all the other countries is something that definitely set the ball rolling in our minds to understand what shall the next decade or couple of decades in future hold for us.

Annual Gas Conclave

Many thanks to ET EnergyWorld for having me as a delegate at the Annual Gas Conclave.

The deliberations and the discussions at the conclave were an eye opener especially with regard to having all energy sources as an essential part of our success and progress story.

The way India s energy needs and solutions would pan out is really an amazing space to be in and as a counsel who practices on the Oil and Gas side, I felt proud to be a part of that space.

It was a delight to hear all speakers especially the Hon’ble Minister who also credited Petroleum and Natural Gas Regulatory Board (PNGRB) for the amendments that it has brought out in its regulations. Furthermore, it was an honour to hear the Hon’ble Member Dr Ashutosh Karnatak (DBA) and also to listen to the pragmatic ideas of Mr. Sarraf, the ex chairperson of Petroleum and Natural Gas Regulatory Board (PNGRB) among the other luminaries of this sector.

Kudos to Mr.Sudheer Pal Singh and his team for putting together the conclave so flawlessly.

Honoured to be back to my Alma Mater as a Judge to the Moot Court Competition held by the Legal Literacy Club for their flagship annual event Rendezvous De Juris.

Infact the interaction, later in the day, with the students, was a tremendous delight. The students were not just very well informed and enlightened, but also asked very apt questions and ensured that the session was super interactive.

I felt so proud and could see such a bright future shinning right before me.

Understanding section 8 of the Hindu Succession Act, 1956 with respect to the Self Acquired Property of a Person’s Ancestor.

Section 8 of the Hindu Succession Act, 1956 reads as under-

“8. General rules of succession in the case of males-

The property of a male Hindu dying intestate shall devolve according to the provisions of this Chapter- (a) firstly, upon the heirs, being the relatives specified in class I of the Schedule; (b) secondly, if there is no heir of class I, then upon the heirs, being the relatives specified in class II of the Schedule; (c) thirdly, if there is no heir of any of the two classes, then upon the agnates of the deceased; and (d) lastly, if there is no agnate, then upon the cognates of the deceased.”

That the Judgment of the Hon’ble Supreme Court in the matter titled “Arshnoor Singh v. Harpal Kaur and Ors.”[1] has as very beautifully given by the quorum of Hon’ble Mr. Justice U.U. Lalit along with Hon’ble Ms. Justice Indu Malhotra and, further, authored by Hon’ble Justice Indu Malhotra explained certain aspects of the above mentioned provision.

After the Hindu Succession Act, 1956 came into force, it has become clear that if a person inherits a self acquired property from his paternal ancestor, the said property becomes his self-acquired property, and it does not remain coparcenery property.

If this position that came into fore after the formulation of the Hindu Succession Act, 1956, this position is very different from the position that existed before the commencement of the Hindu Succession Act, 1956 wherein the parties were governed by the Mitakshara Law and that in the case of the old Hindu Law such a property inherited by a Male Hindu from his paternal male ancestor shall be coparcenery property in his hand vis-à-vis his male descendant upto three degrees below him.

However, in all cases, where the succession opened, after the coming in of the Hindu Succession Act, 1956, as stated herein above the person inherits a self acquired property from his paternal ancestors as a self-acquired property in his name as well.

That the Judgment of “Arshnoor Singh v. Harpal Kaur and Ors.”[2] has explained the above said concept in a very elucidatory manner and the distinction which exists between the position that existed before 1956 and that existed after 1956. That it is further pertinent to mention that even in the case of “Commissioner of Wealth Tax, Kanpur and Ors. V. Chander Sen and Ors”[3] the Hon’ble Supreme Court in para 10 of the above said Judgment has dealt with the question regarding the income or asset which a son inherits from his father when separated by partition, that whether the same should be assessed as income of the Hindu Undivided Family of the Son or his individual income. The Hon’ble Supreme Court in para 10 of the Judgment noted that-

“10.………..There is no dispute among the commentators on Hindu Law nor in the decisions of the Court that under the Hindu Law as it is, the son would inherit the same as karta of his own family. But the question, is, what is the effect of Section 8 of the Hindu Succession Act, 1956? The Hindu Succession Act, 1956 lays down the general rules of succession in the case of males. The first rule is that the property of a male Hindu dying intestate shall devolve according to the provisions of Chapter II and class I of the Schedule provides that if there is a male heir of class I then upon the heirs mentioned in class I of the Schedule. Class I of the Schedule reads as follows: Son; daughter; widow; mother; son of a pre-deceased son; daughter of a predeceased son; son of a pre-deceased daughter, daughter of a predeceased daughter; widow of a pre-deceased son; son of a pre-deceased son of a pre-deceased son; daughter of a pre-deceased son of a predeceased son; widow of a pre-deceased son of a predeceased son.”

Further in para 11 stated-

“The heirs mentioned in class I of the Schedule are son, daughter etc. including the son of a pre-deceased son but does not include specifically the grandson, being a son of a son living. Therefore, the short question is, when the son as heir of class I of the Schedule inherits the property, does he do so in his individual capacity or does he do so as Karta of his own undivided family?”

That, therefore after evaluating the above and after evaluating the observation of Mulla’s Commentary on Hindu Law as well as Mayme on Hindu laws, the Hon’ble Supreme Court categorically held that the express words of Section 8 of the Hindu Succession Act, 1956 cannot be ignored and must prevail. The Hon’ble Supreme Court stated that the Preamble to the Act reiterate that the Act is inter alia to ‘amend’ the law. With that background the express language which excluded Son’s son but included son of a predeceased son cannot be ignored. Thus, the Hon’ble Supreme Court finally held that in the present case that the amount standing to the credit of the late Sh. Rangi Lal, (the predecessor) , after his death, was inherited by Chander Sen ( the successor) in his individual Capacity and not as a Karta of a joint family consisting of himself and his son.

Thus, the above said celebrated Judgments “Commissioner of Wealth Tax, Kanpur and Ors. V. Chander Sen and Ors”[4] as well as “Arshnoor Singh v. Harpal Kaur and Ors.”[5] as decided by the Hon’ble Supreme Court have settled the law on this subject.

As we bid farewell to 2021, I would like to write about Humans of Bombay and Karishma Mehta, the founder and CEO of this amazing organisation.

I had the pleasure of meeting Ms. Karishma Mehta on her recent visit to Delhi, earlier this month. I took an opportunity to show my gratitude to the young CEO for bringing Humans of Bombay into our lives. For the uninitiated, Humans of Bombay revolves around the stories of beings not just from Mumbai but all across India, which have been extraordinary and interestingly it therefore is about each one of us.

Meaning thereby, that it not just elevates each one of us to that exalted position, wherein it gets highlighted that we truly have battled such circumstances that our lives have become extraordinary ; but also gives us a gleam of hope, a ray of optimism as we look forward to unfold the magic called Future.

So as I thank the Superior Power of this Universe for the year 2021, who has through its mysterious ways, inspite of the ups and downs that 2021 brought with it; yet anchored me through this turbulent year; I would also like to express my gratitude to one of the most positive organisations that I came across in 2021 Humans of Bombay.

The Courtroom Genius 

The Courtroom Genius is such an engaging book on the greatest of the great, the most revered Mr. Nani Palkiwala.

But I recently realised, once again, that it is much more than that. (I know we all know that). One of the most beautiful experiences I would like to share - on one of my recent trips to Bahrisons Booksellers, Khan Market, when someone asked for the book - the way the name echoed in the shop (with every staff member saying it with a gleam in their eyes), gave me goosebumps.

It seemed as if the Universe transcends by sending the waves of his greatness across generations which shall always be music to our ears or just like Hon’ble Mr. Justice Krishna Iyer said that truth is like a song- so like the most melodious song that our ears are blessed to hear.

Courage 

Courage is a very important attribute for a litigating lawyer.

Courage we shall always have to adduce the best arguments for our client, courage we shall always have to understand the facts and circumstances that the client is going through and further Courage to assessing the "Z" for the client that is the final outcome which seems in a scenario.

I would also like to borrow the quote of Mark Twain and share the same with you

You Are Made For Litigation (Article 4)

KEEN OBSERVER

As a litigating lawyer, it is always wise to be a keen observer. When one is in the court premises either physically or virtually there is so much to OBSERVE, grasp, absorb and adapt.

This can range from observing the arguments of lawyers, the kind of law that is being advocated, the way it is being advocated, and various other actions and reactions.

Being a keen observer and implementing certain aspects according to your personality and requirement takes you a long way.

Years in Litigation taught me that it is a people's profession. And when I say people's profession it basically means that the profession of a litigation lawyer centers a lot around individuals.

Thus the fact of the matter is that we need to have focus on the client, be empathetic and therefore in that manner understand the pain of the Client and focus on getting relief for the Client by putting in the best research, best efforts and the best application of Law.

Because that is most satisfying.

No Mercy

My post is inspired by the wicket of Ben Stokes (who was batting at 99) that Bhuvneshwar Kumar has taken, just now in the 2nd ODI India v. England.

In litigation also, while arguing against a formidable opposite counsel, one needs to remain strong in one' s argument - come what may- even though in your heart the lawyer on the opposite side (that is your learned friend) is someone whom you admire, someone who may have been like a mentor to you, may be senior to you- but there is No Mercy. (Needless to say that it has to be respectable opposition based on law and facts and not in any other manner).

Today's win of Chelsea in the UEFA Champions League Final 2021 is also celebrating the iconic winning goal of Chelsea's Kai Havertz. He scored his maiden goal when Mendy passed the ball wide out left to Ben Chilwell and he further passed it to Mason Mount who gave a brilliant pass to Kai Havertz leading him to the historic goal.

Women empowerment

26th May is marked as a day when Britian saw it's 1st Female Magistrate in 1913. This made me search for the first Female Magistrate of India. The first Female Magistrate of India is Omana Kunjamma who was also the first female IAS officer of Kerela.

I also take this opportunity to state that how much I have idolised and immensely respected the most revered HMJ Anna Chandy ( the 1st Ladyship to become a judge of the High Court), HMJ Fatima Beevi ( the 1st Ladyship to be Judge of Supreme Court), HMJ Leila Seth ( the 1st Ladyship to become Judge of the Delhi High Court and 1st Ladyship to become the Chief Justice of a state High Court) and also Ms. Cornelia Sorabji ( The 1st lady to be a Advocate in India). They have paved the way for the next generations of women who have made, are making and shall make a huge mark in the field of law. It is but obvious that now, by this year 2019, we have had such Women in law who are great role models - be it the most revered Judges, the respectable lawyers, the thoroughly accompolished partners and members of law firms, the polished in house counsels and even the most promising law students. Our immense gratitude and salute to the forerunners of our field.
